In the early hours of a Saturday morning this month, Hayden James Robertson left a Rockhampton nightclub intoxicated and tried to ride home on a motorbike.

It was 2.20am and the 21-year-old made it as far as Derby Street when police spotted him.

Robertson saw the police car and got scared.

He then made a turn at high speed through a stop sign at the Denison Street intersection.

Robertson continued at high speed along Denison St until he got to the Stanley Street intersection where he turned left onto Stanley Street at high speed.

Robertson made this turn in front of another motor vehicle and its driver had to rapidly apply brakes to avoid a collision.

Police then lost sight of Robertson, but a short time later they came across the same motorbike laying on its side at the end of East Street.

Police spoke to Robertson there.

When asked about his actions, Robertson told police that he had been drinking at a nightclub beforehand and he was scared that they would pull him over.

Police checks revealed the motorbike had been unregistered for 122 days.

After a random breath test, Robertson returned a reading of 0.054.

Robertson pleaded guilty in Rockhampton Magistrates Court on September 22 to driving without due care and attention, drink-driving, and riding an unregistered and uninsured motorbike.

Robertson’s solicitor Samantha Legrady said Robertson was a scaffolder who, on the night in question, had left the nightclubs after having issues “where people wanted to fight him”.

“So he left on a bike to get away,” Ms Legrady said.

The court heard that Robertson had a one-page traffic history and no criminal history.

Magistrate Cameron Press described what Robertson did as “very foolish behaviour”.

“You are fortunate that you haven’t been charged with a more serious offence,” Mr Press said.

“You caused another driver to have to slam their brakes on so as to avoid, clearly, a collision.

“This was very foolish behaviour, no doubt precipitated by alcohol.”

Mr Press imposed four fines totalling $1450 and also disqualified Robertson from driving for six months.
