An on-duty tow truck driver who exposed himself to a woman and slapped her on the bottom, has been sentenced in court.
George William Allen, 51, pleaded guilty in Gladstone Magistrates Court to one count of sexual assault.
Police documents stated that on the morning of June 12 last year, the 51-year-old female victim was expecting her husband’s car to be towed and dropped off at her home in the Gladstone region.
Police said when Allen arrived at the home, the zipper on his pants was broken and he exposed his penis to the woman.
They said Allen held his penis and then slapped the woman’s bottom with an open palm, asking her not to tell anyone.
Allen had no criminal history, and the prosecution submitted a one to two-month suspended term of imprisonment was in range.
Solicitor Jun Pepito tendered a letter to the court that was written by Allen and Magistrate Mary Buchanan read that.
Mr Pepito also tendered references for Allen and the court heard he had a solid employment history.
Ms Buchanan said Allen’s referees “spoke well” of him and they also said they “can’t believe” that he committed this offence.
The court heard Allen lost his job as a result of this incident.
Ms Buchanan said she had to take into account there were two “acts” involved here.
She sentenced Allen to four months’ jail, wholly suspended for an operational period of 12 months.
A conviction was recorded.
