A motorist found a partially naked man in his car in the middle of the night after he went to pay fuel at a Rockhampton service station.
The naked man, a court heard, had been drowning his sorrows after his marriage broke down and recalls snippets from the night he was found wearing only a towel sitting in a stranger’s car.
The car’s owner feared the stranger, Daniel John McGregor, was a car thief and called police.
Police prosecutor Senior Constable Sarah Rowe told Rockhampton Magistrates Court that McGregor, 41, would not get out of the vehicle when asked by the owner and police at 1.40am on April 19, 2023 at the Ampol on William Street and had to be forcefully removed.
“He didn’t know what he was doing,” defence lawyer Samantha Legrady said.
Ms Legrady said her client was on medication at the time and had been drinking alcohol after he had broken up with his wife.
“He doesn’t remember much,” she said.
She said he recalls having a shower and the next memory was being in the car.
Senior Constable Rowe said the car’s owner had the keys on him but had left the car unlocked.
She said when police arrived, McGregor told police his name was ‘Elizabeth’ and purposely wedged his knees under the steering wheel when police forcibly removed him from the vehicle.
Senior Constable Rowe said the defendant was released into Rockhampton Hospital’s care and when an officer attended to deliver his notice to attend court, he hit the female officer, knocking the paperwork out of her hand, spoke over her and rudely towards her.
McGregor pleaded guilty to one count of unlawful use of a motor vehicle, one of contravening police direction and two of obstructing police.
He had a six-page criminal record including convictions for drugs.
McGregor received a three-month prison term, wholly suspended and operational for 12 months along with being placed on probation for 12 months.
