Benjamin Alan Jansen pleads guilty to drunken incident in Royal Mail Hotel, Tewantin

A Nambour man has fronted court after a verbal stoush with partner who was playing the pokies at a popular pub in the Noosa region.

A Nambour man has been banned from a popular Tewantin pub after he was arrested for causing a scene while his girlfriend played the pokies, a court has heard.

Benjamin Alan Jansen, 26, pleaded guilty in Noosa Magistrates Court on July 19, 2022, to being drunk or disorderly in a licenced premise, failing to leave and contravening a direction to leave the licenced premise and obstructing a police officer.

Police prosecutor Sergeant Alison Johnstone said police had been called by staff at the Royal Mail Hotel after Jansen was “yelling and screaming” in the gaming area about 10.18pm on March 29, 2022.

“He was having a verbal argument with his female partner who was playing with the pokies,” Sergeant Johnstone said.

The court heard management became involved when Jansen’s behaviour went “up and down” leading to other patrons leaving the gaming lounge due to their discomfort.

When police arrived at the hotel, Jansen became dismissive of their direction for him to leave the venue.

“He then stood up, clenching fists and puffing out his chests,” Sergeant Johnstone said.

“After further discussion, the police officer had difficulty convincing him he was under arrest.

“(Jansen yelled) “f--k, c--t” directing his abuse at other patrons.”

Sergeant Johnstone said as police tried to lead Jansen out of the venue, he tried to kick the door and was “thrashing”.

“He violently lashed out with his head and was pushed against a wall to control his violence,” she said.

“Once he was secured and handcuffed on the floor, he told police to “f--k off” and wouldn’t enter any meaningful dialogue.

“He repeatedly headbutted the police van pod … and created cuts and bruises to his forehead.”

Jansen told the court he has learnt to deal with his behaviour since the incident.

“My actions were disgusting and I’ve learnt to walk away,” he said.

“I’m sorry for the carry on and obstructing police at the end, it was out of character, I believe this won’t continue.”

Magistrate Kurt Fowler sentenced Jansen and recorded a conviction.

Jansen was fined $2000 and banned from entering the Royal Mail Hotel for 12 months.
