Lawyers for a Mackay man charged over an alleged horror sex act involving BDSM are pushing to cross examine a witness.

It is further alleged the offending involved a BDSM (Bondage, Dominance, Submission, Sadomasochism) act gone wrong.

Mr Fitzpatrick-Giles is on bail after he was granted a conditional release by the Supreme Court in mid February.

His matters were briefly mentioned in Mackay Magistrates Court on Monday when his lawyer Marcus Hahn, of McKay’s Solicitors, said an application for cross examination had been sent to prosecution for consideration in late April.

Mr Fitzpatrick-Giles’s appearance was excused.

Mr Hahn said the application discussed five topics for cross examination with police prosecution consenting to one of the five.

As a result Mr Hahn is pushing for a court-ordered directions hearing regarding the rejected topics.

Anyone convicted of rape faces the possibility of life imprisonment, while torture carries a maximum penalty of 14 years jail if convicted.

In September 2023 new laws were passed allowing those charged with prescribed sex offences such as rape to be named while the matters were still in the Magistrates Court.

Previously offenders facing these charges could only be named once a case had been committed to the district court, sometimes months or more than a year into the court process, and only then if it would not identify any complainant.

Magistrate Damien Dwyer ordered for the defence and prosecution paperwork to be sorted by June 14.

The matter will be listed for committal mention on June 21 and Mr Fitzpatrick-Giles’s appearance will be excused.
