A homeless ex warehouse manager who was asleep in his car was convicted of drink driving when he faced Gympie Magistrates Court on Tuesday.

A homeless ex warehouse manager who was asleep in his car was convicted of drink driving when he faced Gympie Magistrates Court on Tuesday.

Jae Brent Silvester, 38, had been homeless for 18 months and sleeping in cars and parks, the court was told.

He was sleeping in his car in the Moreton Bay region when police breath tested him on December 19, 2021, the court heard. He blew .12 per cent, more than twice the legal limit.

“At the time of the event I was sleeping in my car when the police found me. I had a rental in Scarborough, the lease ran out, the lady sold the house and I couldn’t find residence,” Silvester said.

Silvester said he had been unemployed for a long time since resigning from his previous job as a warehouse manager and had only two job interviews since then but had not been successful.

“I haven’t had a roof over my head and this has been on my mind,” he told the court.

“I just wanted to settle and find a job because I’m only on Centrelink.

“I receive $953 a fortnight from Centrelink and I pay $250 a week for rent. I have a daughter and she’s more independent now, she’s 18.”

Silvester was convicted of drink driving and of failing to appear in Caboolture in March 2022, and was fined $412.

No conviction was recorded for the fail to appear offence, but a conviction was recorded for drink driving.
