A man accused of running amok with a crowbar at Gympie McDonald’s has faced court via video link from the Maryborough jail, despite the jail telling his lawyer he was not there.

The expected sentencing of a Gympie man accused of smashing up a the local McDonald’s restaurant has been slowed amid confusion over which jail he was being held in.

Brenden Zane Doherty reappeared in Gympie Magistrates Court on Monday, June 19, on three charges of entering a premises and committing an indictable offence, stealing, and possessing used pipes or utensils.

However it was the 31-year-old’s appearance by videolink which prompted solicitor Chris Anderson to tell the court confusion as to where exactly Mr Doherty was on remand was creating problems.

Mr Anderson said “three of four separate letters” had been sent to Mr Doherty at the centre ahead of Monday’s appearance.

The court heard each was “returned to the office”.

Mr Anderson said this was under advice the 31-year-old was not there, prompting the solicitor to note “his presence at Maryborough Correctional Facility” in the videolink.

The matter was adjourned three weeks to July 10, with Mr Anderson saying the expectation was it would be a lengthy plea.

Mr Doherty has not yet formally entered any plea to the charges.

Police have alleged he entered the shop, located on the Bruce Hwy opposite Gympie Central Shopping centre, about 7.45pm on Wednesday April 26 while armed with a crowbar wrapped in a towel.

He then allegedly used the weapon to destroy several electronic kiosks before fleeing.

No-one was harmed in the incident.
