The man, who cannot be named to protect the victim’s identity, stood trial at Gympie District Court in April over the charges of rape, attempted rape, and indecent treatment of a child under 16.

He was found guilty by a jury of all charges following a three-day trial.

During the trial, the court heard his crimes came to light in 2021 when the girl’s mother found her diary.

Crown Prosecutor Katrina Overell said in her opening statement a list of notes written by the girl included things like “I ate a butterfly”, “I killed a frog with a fart”, “I am gay”, and “I got raped by my dad’s best friend’s son”.

The court heard the man was not charged with any offence related to the claims made in the diary.

However the diary was the instigating factor for the girl’s family to become aware of what was actually occurring when she was at the home.

Ms Overell said the man’s offending unfolded on two occasions when she was visiting with her family, a regular occurrence given their fathers’ friendship.

During sentencing Judge Bernard Porter said the man’s offending was “brazen and opportunistic”.

The court heard the man’s offending included trying to rape the girl on the floor despite her repeated requests for him to stop, and kissing her “forcefully” when the attack finally ended.

The second series of offences happened while the girl was playing video games with the man’s older brother in the brother’s bedroom.

While they were playing the man started groping the girl, first putting his hand under her jacket and then escalating to putting it down her pants and digitally raping her.

The offending ended when he made the girl masturbate him, the court heard.

Judge Porter said the man had shown a “lack of remorse”

The court heard he had no criminal history.
