A drink driver who threatened to sue police and called one a “f—king fat c—t” has faced court in Maryborough.

Empty cans of Jim Beam in the boot of her vehicle tipped police off to one woman’s drink driving, but her bad behaviour did not finish there.

Police prosecutor Sonia Edwards said on August 13, police were called to an incident in Neptune St, Maryborough.

Police saw Smith driving along Neptune Street at 4.49pm.

She was the only occupant of the vehicle, Sgt Edwards said.

Police activated their lights and sirens and Smith pulled into a carpark at the address they were attending, got out and walked away.

She was detained and appeared agitated and reluctant to speak to police, the court heard.

The officers saw multiple empty cans of Jim Beam in the boot of the vehicle.

The court heard Smith had failed to comply with police directions on three occasions.

She failed to comply and was arrested, Sgt Edwards said.

Smith then started to obstruct police, starting to twist and turn, making it hard for police to keep a grip on her during the arrest.

She started yelling at the officers, telling one “I’ll sue you f —king fat c —t”.

Sgt Edwards said it was a public place and there were people in the area.

Smith then dropped her body weight, causing herself to fall to the ground.

She continued to yell but later complied with a breath test at the police station, returning a reading of .117.

Sgt Edwards told officers at the time she had been drinking over the previous 24 hours.

Duty lawyer Morgan Harris said Smith had become much more cooperative when she was taken back to the police station.

He said on the day in question Smith had been trying to assist her partner, who was suffering from a mental health episode.

She had ill-advisedly been drinking to help herself cope with the situation, Mr Harris said.

He said Smith had been diagnosed with PTSD, and had sought assistance for the disorder.

Magistrate John Milburn said Smith had found herself in a difficult situation and she had consumed a considerable quantity of alcohol.

He said he accepted the circumstances Smith found herself in on that day.

Magistrate Milburn fined Smith $600 and placed her on an eight-month $800 good behaviour bond.

She was disqualified from driving for three months.

No convictions were recorded.
