A man who police allege punched another man outside a regional pub less than two months ago, which caused the victim to pass away after being flown to hospital, has appeared in court for the first time since being released from custody.

Maua Lagaaia appeared in Dalby Magistrates Court on November 14 with family members supporting him in the back of the courtroom.

The mention comes after police allege the 33-year-old struck Western Downs man Lincoln Hoad on September 16 at The Australian Hotel in Dalby which resulted in Mr Hoad suffering serious head injuries. Mr Hoad was taken to the Princess Alexandra Hospital but his life support was turned off.

Mr Lagaaia’s lawyer from Dib and Associates, who appeared on the phone as the Capalaba man’s representation, asked the court for an adjournment so a brief of evidence could be ordered.

Police prosecutor Chris Hutchins said that a brief of evidence had already been ordered and mailed to the Brisbane law firm on October 16 but correspondence between Dalby prosecutions and the man’s legal team showed they were trying to locate the evidence.

“They may be trying to track down where the brief is,” Sergeant Hutchins said.

Mr Lagaaia has been charged with one count of striking to cause death and grievous bodily harm.

No plea has been entered at this point in time.

Acting magistrate Michael Bice adjourned the matter to December 12 at Dalby Magistrates Court and ordered Mr Lagaaia’s bail be enlarged.
