A 15-year-old boy is accused of murdering a teenager during a 30-second clash between two gangs witnessed by shocked beachgoers.

A teenager accused of murdering Hashim Mohamed in 30 seconds of mayhem at St Kilda Beach wants to be freed back into the community.

The 15-year-old boy was one of a handful who was arrested in the weeks after the December 4 gang attack and charged with affray and violent disorder.

He has remained on remand in a youth detention facility since.

But a major seven-week homicide investigation into who was responsible for plunging the knife into Mr Mohamed’s back during the brawl lead police to charge the teen with murder last week.

Wearing a black cap back to front, he appeared via video link in a Children’s Court on Friday where his lawyer was forced to abandon his bid for bail given he was now facing the more serious offence.

Homicide accused can only apply for bail in the Supreme Court.

An earlier court heard Mr Mohamed, 18, was killed during a brawl involving two rival youth gangs: the Original Gangster Killers and the 9’ers.

Mr Mohamed, who police say was a 9’ers member, was allegedly confronted by up to 13 OGK hoodlums when he was stabbed with such force that the knife protruded through his chest.

The knife, which had to be removed during an autopsy, is understood to contain crucial DNA evidence, leading police to his alleged killer.

Investigators have had a mammoth task to identify the brutes involved, trawling CCTV capturing the clash, which lasted about 30 seconds and took place in front of hundreds of shocked beachgoers enjoying the first weekend of summer.

The murder accused is among seven teens who have now been charged over the affray.

He is the only one charged with murder.

The prosecution told the court they would need more than the usual six-week deadline to prepare the brief of evidence for the case, with crucial evidence, including a pathology report not expected to be finalised for 12 weeks.

“It actually took the police until recently to compile enough evidence to charge him,” the prosecutor said.

The magistrate did not grant the 12-week extension, citing the teen’s youth and the fact he was in custody, and told police to work towards providing as much evidence to the defence by early March.

“The prosecution indicated critical evidence won’t be available in that time,” she said.

“I know the reality is it won’t be ready that day.”

But she said she wanted to keep the case progressing and timelines as tight as possible “out of an abundance of caution”, given the accused remained on remand.

The magistrate said the prosecution could apply for an extension again closer to that date.

The teen will return to court, alongside his co-accused, next month.
