Mendo Vrskovski, 48, charged with dangerous driving causing death over Pascoe Vale South crash

A driver accused of causing the death of a cyclist in Pascoe Vale South claims one thing affected his vision but a magistrate says it’s “impossible to see how that could be a feature of the case”.

A magistrate has rejected the idea that a tow truck driver, allegedly high on meth when he hit and killed a cyclist, was affected by sun glare.

Mendo Vrskovski, 48, has been charged with dangerous driving causing death over the Pascoe Vale South crash in April.

A court earlier heard he had methamphetamines in his system when he drove through a give-way sign and struck a Brunswick West man, 43, who was riding a bicycle.

Defence barrister Erin Byrt said there were issues in how or why the cyclist could not be seen, possibly due to the impact of sun glare.

“It was 1pm wasn’t it?” Magistrate Andrew McKenna asked.

“If the sun was where it would typically be in every day since the dawning of the earth, it would be overhead or likely to the north.

“It’s not a case of driving into a rising or setting sun – impossible to see how that could be a feature of the case.”

Suggestions that the cyclist could have been speeding in a 60km/h zone along Melville Rd were also quickly dismissed.

“He’d be an Olympic quality cyclist if that was the case,” His Honour said.

An application by Mr Vrskovski’s lawyers to cross-examine a crash reconstruction expert was approved.

The case will return to court for a one-day pre-trial hearing on November 4.
