Accused killer driver’s emotional court outburst

An accused killer driver has grinned and blown kisses from prison as details of her alleged driving history was revealed.

Alisha Fagan is charged with dangerous driving causing the death of much-loved Sunshine West grandfather Sedat Hassan earlier this month.

Ms Fagan faced the Melbourne Magistrates’ Court on Tuesday over a series of unrelated summary matters, including allegations of dangerous driving in a police pursuit, assault with a weapon and driving on a suspended learners permit.

The more than 30 charges are alleged to have occurred in a 12 month period beginning in April last year.

The court heard all but one of the outstanding matters had been resolved with the cases to return to court on July 19.

It was not detailed how the matters were resolved.

Ms Fagan appeared via videolink from Dame Phyllis Frost Centre where she has been held since her arrest at the crash scene in the early hours of June 9.

The former beauty therapy student on Tuesday grinned and jumped up and down waving to friends and family who appeared on the court link.

Ms Fagan continued to make the peace sign and love heart hand gestures throughout the administrative hearing, prompting Magistrate Johanna Metcalf to remind those watching “we are in a courtroom”.

Charge sheets released by the court on Tuesday reveal for the first time, the extent of Ms Fagan’s alleged offending prior to the deadly crash.

On Anzac Day 2021, the 21-year-old was charged over an alleged affray outside a city short-stay apartment during which she is accused of assaulting another woman with a weapon, kicking her and stealing the alleged victim’s iPhone and Tommy Hilfiger handbag.

Ms Fagan is also charged with assaulting an emergency worker during the alleged altercation.

On August 13, Ms Fagan was charged with driving while suspended, giving a false name and address, and failing to present her licence to police, court documents allege.

Two days later, she was again charged with driving while suspended and giving officers a false name.

On September 1 last year, Ms Fagan was charged with failing to comply with the Chief Health Officers’ lockdown directions and giving a false address.

A week later on September 7, she was charged with driving while suspended.

On October 13, Ms Fagan was charged with dangerous driving over a police pursuit at Hoppers Crossing during which she allegedly failed to stop at police direction.

The following month she was charged with possessing a controlled weapon without lawful excuse.

And on April 17 this year, Ms Fagan was stopped by police on Chapel St in Windsor and allegedly gave officers a false name and refused to undergo a breath test.

She was also charged with breaching bail conditions which prevented her from driving.

Ms Fagan last week sobbed as she was denied bail over the crash which killed Mr Hassan, with Magistrate John Hardy saying the risk was just “too high” that she will drive again.

Mr Hardy said he was not prepared to release Ms Fagan into the community, given her alleged dangerous driving history.

During that hearing Ms Fagan rocked back and forth sobbing, crying: “I don’t want to be here, I want to be the person I wanted to be when I was younger”.

Mr Hardy did, however, offer the young woman a morsel of hope, saying if residential rehabilitation can be organised for Ms Fagan, he would revisit the application.

The court heard on Tuesday Ms Fagan would shortly undergo an assessment in regards to suitability for a rehabilitation centre in St Kilda with a decision likely to be made in the next week.

Ms Fagan will return to court on July 19 for a further mention.
