A woman accused of killing a grandfather in a Sunshine West crash has wailed in court as a magistrate refused to set her free.

Accused killer driver Alisha Fagan has wailed as she was denied bail, with a magistrate saying the risk was just “too high” that she will drive again.

Ms Fagan has been charged with dangerous driving causing the death of much-loved grandfather Sedat Hassan in Sunshine West in the early hours of last Thursday morning.

Magistrate John Hardy on Tuesday afternoon said he was not prepared to release the 22-year-old into the community, given her alleged dangerous driving history which involved charges of driving in a police pursuit, drink driving and speeding up to 35km/h over the limit.

Ms Fagan rocked back and forth sobbing, crying: “I don’t want to be here, I want to be the person I wanted to be when I was younger”.

Mr Hardy did, however, offer the young woman a morsel of hope, saying if residential rehabilitation can be organised for Ms Fagan, he would revisit the application.

“I do want to help you, but what happened last Thursday morning just has catapulted your circumstances into a different league,” Mr Hardy told her.

“You’re already in a huge amount of trouble,” he said.

Ms Fagan has denied she was driving her white Audi at the time of the deadly smash, telling police she was instead sitting in the back passenger seat, drunk, with three men of African appearance that she didn’t know.

But on Tuesday, police revealed CCTV footage allegedly showed Ms Fagan sitting in the drivers’ seat of the car just 13 minutes before the crash.

The former beauty therapy student appeared from the Dame Phyllis Frost Centre where she was held since Friday after Magistrate John Hardy raised serious concerns about her release into the community.

The court heard at the time of the crash Ms Fagan was on bail for a series of driving offences including dangerous driving in a police pursuit, drink driving and speeding up to 35km/h over the limit.

During the emotional hearing on Friday, Ms Fagan wailed: “Daddy please help me” to her father who sat in the body of the court with several family members and friends.

Through sobs, the young woman said she tried to help Mr Hassan in his final moments.

“I felt his last heartbeat,” she cried.

“He was still alive, I put my hand on his neck, he still had a pulse,” she said.

“I can’t sleep, all I can think about is someone dying in front of me.”

Prosecutor Michael Roper told the Melbourne Magistrates’ Court on Tuesday, Mr Hassan’s son was watching the hearing via video link, causing Ms Fagan to rock back and forth sobbing.

Ms Fagan could be seen repeatedly whispering “please god” and clutching a blue stress ball during the hearing.
