An accused killer driver broke down in the dock and screamed “I tried to help him” as she begged to be released on bail.

Alisha Fagan, 22, wailed in court as details of the horror smash which killed much loved grandfather Sedat Hassan in Sunshine West in the early hours of Thursday morning were aired.

Ms Fagan on Friday afternoon applied for bail despite police opposing her release, arguing she was an “extreme risk” to the safety of the public due to her driving history which included allegations for dangerous driving in a police pursuit, drink driving and speeding up to 35km/h over the limit.

Several family members sat in the body of the court, including her father and stepmother, who sobbed as the young woman rocked back and forth in the dock.

At one point during the bail hearing, Ms Fagan broke down crying loudly, forcing Magistrate John Hardy to halt the application and address the accused directly.

“I need you to take a couple of deep breaths,” Mr Hardy said.

“I know this is really difficult but we’ve just got to do our best to get through this afternoon,” he said.

Detective Senior Constable Jason Barry-Bassett told the Melbourne Magistrates Court Ms Fagan had refused to tell investigators who else was in her Audi sedan following her arrest at the scene.

The court heard she told first responders three men of African appearance – one of whom she said was the driver – had fled the scene while she stayed behind.

Ms Fagan initially gave police a false name and address and was allegedly found with two Xanax tablets and a kitchen knife.

She claimed in her record of interview she didn’t know the other occupants’ names and had only met them that night.

But hours after her arrest, another woman came forward to tell police she was a passenger in the car and named Ms Fagan as the true driver, the court heard.

Ms Fagan could be seen shaking her head as she listened to the account.

Her defence lawyer said the female witness was potentially unreliable.

“That witness ran from the car,” she said.

“(Fagan) remained with the deceased until police arrived,” her lawyer said.

“She is reliving those moments when she is on her own,”

“She said the most terrifying thing is being on her own,” she said.

Detective Sen-Constable Barry-Bassett told the court Ms Fagan was on bail for three separate matters at the time of the crash.

Ms Fagan cried “please Daddy, help me” from the dock as Mr Hardy warned he may not be able to make a decision on bail before the long weekend.

Richard Fagan jumped from his seat and ran to the dock, telling his daughter “I’m always with you”.

“It’s going to be OK,” Mr Fagan called out as he was forced back to his seat.

The court heard the young woman was suffering significant mental health issues.

“It all smacks of a young woman who is completely out of control,” Mr Hardy said.

The court heard Ms Fagan had been released on bail for unrelated matters just six weeks earlier.

Mr Hardy said things may have been very different had she not been bailed then.

Ms Fagan will stay behind bars until Tuesday after Mr Hardy deferred his decision on bail.

The court heard a bed at a residential rehabilitation facility for Ms Fagan would not be available for up to three weeks.

Mr Hardy told the young woman he was not prepared to release her into the community without professional support in place.

“It raises real concern from my point of view, what’s going on with your client,” Mr Hardy told defence lawyer Ms Colliver.

“She is completely out of control,” he said.

Ms Fagan will be remanded at Dame Phyllis Frost Centre over the long weekend.

The matter will be recalled on Tuesday.
