Petition to bankrupt former AFL agent Ricky Nixon dismissed after no-show

An attempt to bankrupt former AFL player agent Ricky Nixon which has dragged on in the courts for most of the year has finally come to an end — seventh time lucky.

An attempt to bankrupt former AFL player agent Ricky Nixon has been dismissed, bringing the saga which has dragged on for more than seven months, to a close.

Nixon, 61, went up unopposed at the Federal Court on Thursday in the dispute between himself and Melbourne businessman Greg O’Shea — who earlier this year filed a creditor’s petition, alleging Nixon owed him $40,000 over the sale of footy tickets.

It was the seventh time the matter had been brought before the courts since April.

The dispute stemmed from September 2023 when O’Shea and Nixon made an agreement Nixon would receive a commission for selling five corporate hospitality tickets to the AFL grand final that O’Shea owned.

It was claimed the tickets were sold for $40,000, at $8000 each, but O’Shea alleged he received no money from Nixon for them.

Nixon denied any wrongdoing throughout the saga.

Dressed in a blue polo and representing himself — with neither Mr O’Shea nor his legal team appearing in court — Nixon submitted the total money he owed was about $900, factoring in the difference between $8000 he initially owed Mr O’Shea and $7100 he was owed from the businessman.

“The amount of money (allegedly owed) wasn’t right,” Nixon told the court.

“He owes me $7100 ... it’s a minor amount owed which is probably why he hasn’t arrived today. It’s $900, it’s not a bankruptcy matter that’s for sure.

“To be honest I expected them to meet me outside court today to settle it but they didn’t turn up.”

Nixon also said Mr O’Shea had “furniture in my garage” that hadn’t been picked up for four years.

“I’m about to move house and he hasn’t replied to any messages either,” he said.

The court heard Nixon served Mr O’Shea a notice of grounds of opposition to the application to bankrupt him in October.

Nixon also told the court he was under the impression Mr O’Shea or his legal team would appear at court on Thursday.

“He called my lawyer yesterday and asked if I wanted to do a deal with them and I said no, I’ll see you in court,” he said.

“I’m not surprised they’re not here, but that’s not my problem.”

But when Registrar Robyn Curnow questioned why Nixon did not have his lawyer represent him, Nixon replied he “choose(s) to represent myself these days”.

Ms Curnow said due to Mr O’Shea’s unexplained absence in court it was “not necessary to adjudicate the petition”.

The creditor’s petition was dismissed.
