William Smidth pleaded guilty to indecent acts of children under 16 at Broadmeadows Magistrates’ Court

A vile grub who told an eight-year-old girl “it will be a quick one” before sexually assaulting her has been told his offending will have a lifelong impact on his victims.

St Alban’s William Smidth, 27, appeared at the Broadmeadows Magistrates’ Court on Tuesday, where he pleaded guilty to indecent acts of children under 16.

Between 2015 and 2018, Smidth, who was born and raised in Samoa, sexually assaulted two “vulnerable” girls on separate occasions.

What happens after a sexual assault?

In 2015, 18-year-old Smidth walked into one of the girl’s bedrooms, removed her blanket, and took off her tights and underwear, leaving her naked from the waist down.

He then pulled the girl towards him by her legs until she was halfway off the bed before he sexuall assaulted her

In 2016 a then 20-year-old Smidth told one girl that “it will be a quick one” before pulling her pants and underwear down, getting on top of her and sexuall assaulting her

Smidth, who attended Hume Central Secondary College, again performed an indecent act one one girl in 2017.

The court heard Smidth again told the little girl, “It will be a quick one,” before getting on top of her and putting his penis between her upper thighs and rubbing it, which the victim said “felt disgusting”.

Smidth, who plays rugby, also performed an indecent act on another girl on three occasions.

What to do if you think a child is being abused

The court heard the girls told an adult in 2022 about the indecent acts.

“He’s had his hands all over me, near my bum and private parts,” one girl said, while the other said “someone touched me … someone raped me.”

Smith’s defence lawyer, Yusif Shamoon, told the court his client had an “extremely difficult upbringing” and was bullied.

“He’s extremely reserved; he does not talk to anyone. The only person he talks to is his partner,” he said.

“The doctor (who conducted a psychological report) states he is an unsophisticated man and lacks education. He attended Hume Secondary College but was bullied throughout high school and never engaged well. He was enrolled in an engineering course after year 12 but dropped out because of depression and anxiety.

“He has always found physical sport more interesting and has been good at sport … He played rugby, received a rugby scholarship and went to Sydney and trained for three months but did not pursue it because of his mental health,” Mr Shamoon said.

Mr Shamoon said Smidth lived in Mildura before moving to Melbourne and was employed as a general labourer at a warehouse in Tullamarine.

“He is extremely remorseful. he stated, ‘Every time I think about it, I ask myself why I did it. I have a lot of regrets, and I’m really sorry for what I did,” he said.

Sex is complicated and so are our consent laws

The police prosecution said Smidth’s offending was “quite brazen and opportunistic” and his two victims were “vulnerable and young”.

“The impact of this offending on the victims will be lifelong … even now, they’re still children,” he told the court.

Magistrate Belinda Franjic said this type of offending was “very serious” because of the two victims’ young age.

“It’s a very difficult case because, on the one hand, there’s serious offending against two children on three separate occasions … there are some matters that reduced the moral culpability of the offender,” she said.

Smidth will be assessed for a community corrections order and sentenced early next week.
