Rabii Zahabe and Jaeden Tito delay case over alleged Gavin ‘Capable’ Preston murder

Two Sydney men accused of killing underworld figure Gavin “Capable” Preston in a execution-style hit at a Keilor cafe have had their case delayed.

Two Sydney men accused of killing a notorious underworld figure in an execution-style shooting in Melbourne’s north have had their case delayed.

Rabii Zahabe, 24, and Jaeden Tito, 22, were set to appear at the Melbourne Magistrates’ Court on May 10, each facing a murder charge, however the court heard their defence teams had asked for a six-week delay.

The pair have been accused of carrying out the violent daylight shooting of Gavin “Capable” Preston on September 9 in 2023.

Both men were arrested in Sydney, shortly after the shooting.

Mr Preston died after being shot up to 10 times, leaving his body riddled with bullets.

He had been dining at Sweet Lulu’s in Keilor with Abbas Maghnie Junior, known as AJ, the son of crime figure Nabil Maghnie.

Chaos ensued after a hooded man dressed in black started running towards the duo.

Abbas Junior was also shot in the stomach during the ambush and taken to hospital.

Preston was one of Melbourne’s most notorious underworld figures and had only been released from prison eight months earlier, after serving an 11-year-sentence for murder.

Given the nickname “Capable” for his ability to be capable of almost anything, Preston had recently had the moniker tattooed onto his neck.

In court on Friday, the adjournment was granted.

Mr Zahabe and Mr Tito will remain in custody and are set to appear in the Melbourne Magistrates’ Court on June 21.
