A man, already on bail, strangled a woman so badly she lost consciousness after she refused to participate in a threesome.
Adam Winmar, 30, pleaded guilty in the Heidelberg Magistrates’ Court on Tuesday to seven charges, most notably strangulation and common law assault.
On September 23 last year, Winmar proposed a three-some between the woman and his friend, which the victim refused.
The following day, Winmar pushed the victim, strangled her with is right hand and squeezed for up to 20 seconds, causing the victim to lose consciousness while urinating herself.
She also suffered a blood nose as a result of Winmar’s assault.
The victim was taken to the Austin Hospital where she was “visibly distressed” and had suffered neck and head soreness.
Winmar was promptly arrested on September 24 and appeared before the courts.
On January 16, while out on bail, Winmar was arrested in Heidelberg West holding a small kitchen knife.
He has been in custody since, where he has spent 60 days in the Metropolitan Remand Centre.
The court heard Winmar had spent “two minor periods in custody” and “had significant priors”, but Magistrate John Bentley noted his last “real” offending was in 2020.
Winmar had “clearly had his battles over the years”, the court heard.
Mr Bentley said it was likely he would serve a four-month prison sentence followed by a community corrections order (CCO), which means he would be released in June having already been in custody for two months.
The CCO would likely be drug and alcohol rehabilitation related, the court heard.
Winmar will be assessed for a CCO and return to court on April 2 where he will be sentenced.
