A Frenchman with an expired visa who had been calling Mildura home has had serious child sex abuse material charges struck out in lieu of his imminent deportation.
Mickael Combes had requested to be deported from the country rather than stand trial for allegedly possessing child abuse material.
Combes has been in trouble with law consistently during his stay in Australia, previously spending time in custody for running amok on Mildura roads.
Prosecuting lawyer, Ailsa McVean told the court they were happy to withdraw the charges.
“He’s not the main offender. It appears his co-accused … is the main offender in relation to the (child abuse materials).”
Ms McVean also highlighted that Combes had alerted a healthcare worker about the existence of the images.
“Given his role in the offending being relatively minor, given the circumstances that he is to be deported, it has been considered not in the public interest (to pursue the charges).”
Although it was expected Combes would be leaving Australian shores tomorrow, he is likely to be shipped off sometime next week instead due to some confusion with his paperwork.
Justice Patrick Southey said to Combes, “Your time in Australia has not been a happy one, and you’re not going to be coming back – is that correct?”
Combes replied, “That is correct, your honour.”
Combes will spend the rest of his time in the country in immigration detention.
