A Shepparton motorist who failed to navigate a curve in a country road near Euroa and crashed into a tree, killing his passenger, has indicated he will plead guilty to one charge.
Abdul Fatah Faizi, 52 fronted the Shepparton Magistrates’ Court on Wednesday after his committal earlier this month.
Mr Faizi will reappear in court on June 11 where he is expected to plead guilty to careless driving after his ute ran off the Euroa-Mansfield Rd and down an embankment about 10.20pm on July 9, 2023.
The car hit a tree head-on before travelling another 30m down the embankment to come to a stop against a different tree.
Passenger Eid Mohammad Enam Khail, 59, died after being flown to Melbourne in a critical condition.
Mr Faizi and another man were rescued by emergency services and taken to hospital with non-life-threatening injuries.
During the committal, the court heard the ute was travelling at a consistent speed when the driver tried to brake and steer the car to follow a bend in the road.
Three seconds later, the airbags deployed.
Magistrate Olivia Trumble said the road signs leading up to the crash site “made no sense” and evidence suggested Mr Faizi was a conscientious driver.
Mr Faizi’s bail was discharged.
