Latrobe Valley Magistrates Court is a hive of activity for hundreds of cases every week.

This week magistrates dealt with everything from drug trafficking to driving offences.

Take a look at some of the cases the court saw this week.

Tobi Borzacott

A man was placed on a three-month good behaviour bond after he caused a stir at the Baw Baw Alpine Village last year.

Tobi Borzacott, 27, appeared in the Latrobe Valley Magistrates Court where he pleaded guilty to one charge of unlawful assault.

On August 27, Borzacott was sitting near a group of people who had just finished an eight-hour shift at the ski hire shop in the Baw Baw Village.

Borzacott then approached one of the men and asked if his name was Tom.

When the man replied yes Borzacott began pushing him in the chest and alleged he had been violent towards his mother when they were married.

“I have been looking for you for 15 years,” Borzacott said. “You bashed my mother.”

Borzacott was eight-years-old when Tom and his mother separated.

Borzacott pushed him about six times before leaving but later returned to the venue to apologise for the disruption he had caused.

In September he was interviewed at the San Remo police station but he provided no comment about the specifics of the incident.

The defence told the court it was a matter of the two men being in the same place at the same time and it wasn’t a “quest for vengeance”.

“He let his emotions get the better of him,” he said.

Borzacott was placed on a three-month good behaviour bond.

Shane Nelson

A carpenter was fined after police caught him driving without properly displaying a registration number on a trailer in 2021.

Shane Nelson, 34, faced the Latrobe Valley Magistrates court on Monday where he was fined without conviction over the 2021 offending.

The court heard Nelson was pulled over by Bass Coast Highway Patrol on the Bass Hwy on June 29, 2021, after they noticed the trailer he was towing blocked his back registration plate.

The trailer was not required to be registered but it was still a requirement for the car’s registration plate to be visible from behind, or for the registration number to be on the back of the trailer.

The carpenter was towing a trailer carrying mattresses, which the court heard he was picking up for his young children.

The court heard he originally tried to contest the charge, arguing the “nature” of the charge was “ambiguous”.

However, magistrate Andrew Halse disagreed.

He said it was “clear and obvious” the plate was not visible.

“The evidence clearly proves the number plate was not visible,” he said.

Nelson was fined $300 without conviction.

Jordan Gelsi

A man was placed on a good behaviour bond after he tried to use a fake script to buy valium at two Gippsland pharmacies.

Jordan Gelsi faced the Latrobe Valley Magistrates court on Tuesday where he pleaded guilty to two charges of possessing valium.

In August 2022, Gelsi took a fake script for 50 5g valium tablets to a pharmacy in Moe.

The pharmacist noted some errors and refused to provide the tablets.

A few days later Gelsi took the script to the Discount Chemist in Morwell where again staff noticed some errors in the script.

They asked if Gelsi could provide ID and he said he couldn’t.

Gelsi was told it would be a 15-minute wait so he left the store but failed to return.

He was interviewed in October in relation to the offending where he told police officers he had “used Microsoft Word” to create the script.

He was convicted and placed on a good behaviour bond for five months, with a condition he engaged with alcohol and drug counselling.

Jason Sell

A 52-year-old man was assessed for a community corrections order after he pleaded guilty to trafficking heroin.

Jason Sell appeared in the Latrobe Valley Magistrates Court on Tuesday where he pleaded guilty to trafficking heroin.

The court heard that on April 4, 2022 police executed a search warrant at his Moe home where they found a bag containing 3.5g of heroin in his wallet.

The court heard police also found scales, foil and needles.

Sell told police he used the scales to divide his heroin into smaller amounts.

During the search warrant police also seized a mobile phone which revealed messages in which Sell told people he had “stronger gear” and “needed cash ASAP”.

When police interviewed Sell he told them he “only helped a few friends out” and sold the drug for $50 per .1g.

Sell’s defence said he had led a life “consumed” by heroin but he was getting medical assistance.

Sell was assessed for a community corrections order.
