A RESTAURANT worker repeatedly punched a man on the city’s tram tracks in a fight sparked by jealousy.
Antonio Gatt unleashed the flurry of punches after the victim kicked out at him because Gatt was with his ex-partner.
Gatt, 22, left the victim lying on the tram tracks before coming back and dragging him onto the platform about 4.30am on January 28.
Moments later the victim pushed Gatt again. But Gatt walked away from him.
Gatt pleaded guilty in the Southport Magistrates Court on Thursday to one count of affray.
Magistrate Louisa Pink fined him $900 and a conviction was recorded.
“You were extremely fortunate that there were not much more significant injuries to the victim of your assault but I do not consider your conduct on this occasion to indicate a propensity for violence,” she said. “It appeared to me that you only responded in the face of provocation.”
Defence lawyer Farshad Sarabi, of Hannay Lawyers, said Gatt had been out with the women when they came across the victim, the woman’s ex-partner.
He said they got into a verbal argument before the victim kicked at Gatt.
“My client did take steps back to avoid the fight but I can see that he did go too far,” he said. “To his credit once his passions cooled he did move him off the tram tracks and sat him up.”
Mr Sarabi said Gatt had checked himself into a 12-month residential rehabilitation facility two months ago.
