The company operating a popular Gold Coast bar and cafe has been accused of breaching Covid-19 lockdown laws by serving customers when restricted to takeaway or delivery only.

The Henchman Miami has been charged with failure to comply with a public health direction.

Its director, Jared Fairall, appeared in the Southport Magistrates Court on Monday for a brief mention of the matter.

Magistrate Janice Crawford adjourned it to October 10.

She approved solicitor Farshad Sarabi’s request for his client to not be required to appear in court for the next mention.

The Gold Coast Public Health Unit allege The Henchman Miami served patrons at the premises during the city’s final Covid lockdown when it was only allowed to operate as a takeaway and home delivery service, court documents stated.

The alleged offence occurred on July 31, 2021 between 4pm and 8.41pm

“Between 4pm and 8.28pm there were 51 invoices generated for the sale of liquor and/or other beverages at the premises, with payments received totalling $684,” the court documents stated.

“Between 4pm and 8.41pm there was more than one patron consuming liquor and/or other beverages at the premises.

“The activities and/or business permitted and/or carried out by the defendant at the premises was done so contrary to the (public health) direction.”

In December, Mr Fairall was accused of making abusive comments online after criticism of an attendee at an anti-vaccination mandate rally.

He allegedly called a woman “the worst type of human in the world” and a Facebook group she participates in an “anti-male, dick-hating, ugly side of feminism slag whores group”.

The woman claimed the comments were made in response to posts criticising The Bennies frontman Anty Horgan for performing at an anti-vaccine mandate protest.

Last month, a barman at The Henchman walked free from court on a suspended sentence for trafficking cocaine to an undercover cop via social media app Snapchat.

Joel Jaimie Pavlides, 20, who was working at the bar while pushing cocaine, was sentenced to four years prison, wholly suspended for five years, on the most serious charge of trafficking in the drug between January and May last year.
