A woman who witnessed the brutal assault of a cleaner in the toilet of a popular bar says she was “traumatised” and “disgusted” by the unprovoked attack.

Ex-Army aircraft technician Billy Dean Fallon, 28, exploded out of a female ambulant toilet and began repeatedly punching a Nightjar cleaner at about midnight on January 20 in Burleigh Heads.

The cleaner had been knocking on the unlocked door for about three minutes before he tried to enter.

At the beginning of the video you see three girls go into bathroom cubicles and on their way out they stopped to help the cleaner.

One of the girls who was wearing an all black outfit said she ran out and grabbed the bar manager and security as soon as she saw the fight break out.

“He was just doing his end of night check and was trying to hurry along a couple that was taking their time in the cubical,” she said.

She was seen in the video trying to peel the men off of each other.

“Security were pretty useless,” she said.

At the end of the video she was seen telling the couple to leave.

“Soon after the video ended we found the man’s phone on the floor,” she said.

“The man who had committed the assault had run off and the girlfriend came back. She demanded for his phone back but we had already handed it to police.”

The woman said she was “disgusted” by the whole situation.

Fallon pleaded guilty in the Southport Magistrates Court on Monday to assault occasioning bodily harm.

Magistrate Michelle Dooley sentenced Fallon to 12 months’ prison with immediate parole. She also ordered him to pay the victim $1500 in compensation.

‘Intimate’ toilet tryst ends in brutal bashing

An ex-Army aircraft technician severely bashed a cleaner who interrupted him in the “midst of an intimate encounter” in a nightclub toilet.

Billy Dean Fallon exploded out of the female ambulant toilet cubicle and began repeatedly punching the cleaner about midnight on January 20 at Nightjar, Burleigh Heads.

The cleaner had been knocking on the unlocked door for about three minutes before he tried to enter to do his job.

Fallon, 28, pleaded guilty in the Southport Magistrates Court on Monday to assault occasioning bodily harm.

“The door appears to have been unlocked and the cleaner knocked for a period of time before attempting to open the door,” she said.

“This individual was engaged in his normal employment, was clearly unaffected by alcohol and just going about his normal duties as part of his job.”

Magistrate Dooley said there were a large number of assaults that seemed to happen in nightclubs and that was of “community concern”.

CCTV footage played to the court showed the cleaner entering the hallway where the bathrooms were positioned and using a broom and pan to pick up toilet paper and clean the area.

He can be seen knocking on the door of the female ambulant toilet cubicle repeatedly using both his hand and broom handle.

He does so for about three minutes before attempting to push open the unlocked door.

A shirtless Fallon then explodes from the cubicle with his fists flying and punching a number of times.

The cleaner backs away until he is slammed against the wall, leaving a hole in the plaster.

The cleaner then falls on Fallon who is continuing to punch him.

During the scuffle Fallon’s partner also emerges from the cubicle and watches on and does not appear to make any attempt to stop the fight.

Security arrives and manages to break the fight up.

The court was told the pair had been in the “midst of an intimate encounter”.

The cleaner was left with a broken nose but did not give a victim impact statement.

Defence lawyer Angus Edwards, instructed by TWC Lawyers, said the behaviour was out of character for Fallon.

He said Fallon had grown up in Grafton where assaults in toilets were common.

“He was in there becoming intimate with his partner … they were in the midst of becoming intimate when someone started banging on the door,” he said.

“He acted impulsively, he acted protectively and he thought he was protecting himself and his partner.”

Mr Edwards said Fallon was intoxicated at the time and had an alcohol problem which he developed while in the Army.

Fallon currently works as a fly-in-fly-out worker.

His partner was there supporting him and left the courthouse before he did.

Fallon waited almost another two hours to leave before running out with his lawyer Troy Smith, of TWC Lawyers, with a jacket over his head.

Sources told the Bulletin, Fallon had attempted to get security to open a side door for him.
