Mongols bikie Harley Barbaro signed off jail-cell letters to gang mates accused of murder with “love you dearly MONGOL ON my brother … BARBZY”, a court has been told.
The notes were sent from his wing to jailbirds in different prisons. They included Peter Cumins and Fidel Gunes, both of whom are accused of the 2020 murder of Finks bikie Shane Bowden.
Eight other men have been charged with Bowden’s execution-style killing. They are all still before the courts. It is not suggested Barbaro had anything to do with the alleged murder.
On Friday, the 29-year-old pleaded guilty in the Southport Magistrates Court for breaching bail, driving without a licence.
He was subject to bail conditions banning him from contacting other Mongols gang members. Those conditions were imposed in October last year after Barbaro was charged with habitually consorting.
The bail conditions were never revoked after Barbaro was remanded in custody in March this year for an alleged assault at a Helensvale gym.
Court documents tendered to the court on Friday detail a note Barbaro wrote to Cummins on April 12 this year.
“Shit luck I didn’t get bail, my barrister is appealing it he reckons it (sic) bullshit they just reckon I’ll consort and mix with club 113% Mongol HAHA,” he wrote.
Barbaro closed the letter: “I love you dearly MONGOL ON my brother … BARBZY 1%ER MFFM.”
It is understood MFFM means Mongols Forever, Forever Mongols.
Barbaro is in Arthur Gorrie Correctional Centre while Cummins is in the Brisbane Correctional Centre.
On May 5, Barbaro wrote another letter to Cummins, discussing Mongols affairs, movement of club members in prison and an arson attack of Barbaro’s barber shop.
Barbaro also complained about letters from Cummins not getting through the corrections mail system.
“I’m filthy they took your letter and seized it for OMCG Shit,” Barbaro wrote.
He signed off the letter “BARBZY 1%er”.
The court documents show that on April 28 Barbaro wrote a two-page letter to Gunes passing on news of other Mongols members before the courts.
He finished that letter with: “BARBZY 1%ER LMDM”. It is understood LMDM means “live Mongols, die Mongols”.
The court documents show that on May 5 Barbaro wrote a letter to Luke Tobin, also known as Luke Maksoud, another Mongols member.
Barbaro and Maksoud were both in custody for allegedly assaulting a Rebels gang member outside the Iron Asylum Gym on February 28. That matter is still before the courts.
The court documents tendered on Friday show that Barbaro wrote to Tobin explaining his contact with other Mongols members in custody.
He signed the letter off with “BARBZY 1%er”. The court was also told Barbaro was caught twice riding a motorcycle without the correct class licence.
Magistrate Janice Crawford placed Barbaro on six months’ probation, fined him $700 and disqualified him from driving for three months.
Magistrate Crawford said a lot of the information in the schedule of facts was “not particularly relevant”.
Barbaro’s barrister Marty Longhurst, instructed by Moloney MacCallum Lawyers, said: “He grew up in housing commission in Molendinar and that is where he met all these boys.
“All these ‘rascals’ that police light to paint my client as conspiring to commit all these terrible offences.”
Mr Longhurst said Barbaro had simply been writing to his mates.
“Yes, these people have been charged with this heinous crime but ‘oh, you better look at him’,” he said.
“And what is he saying, ‘I love you my brother … got denied bail … how terrible’.”
Mr Longhurst said Barbaro thought his bail did not exist anymore because he was back in custody.
He said Barbaro’s partner was expecting their second child in April and Barbaro wanted to be out of custody in time for the birth.
“For all the bluster and sensationalism associated with him, he is a pretty functioning person,” he said.
Barbaro is expected to apply for bail on Monday in relation to the alleged assault in Helensvale.
