A bikie’s mum is “cranky” about being left to fight a two-year legal battle because her son hid a rifle, revolver and bulletproof armour in her garden shed, a court has been told.

Grace Margaret Gearing claims she had no idea her son, Victor Wolfram, had hidden the weapons at her home.

Gearing was in Southport Magistrates Court last week facing charges of possessing weapons, possessing tainted property and possessing explosives. Because of the charges she cannot work as an NDIS worker.

It is alleged bulletproof armour, a rifle, revolver, ammunition and a wad of cash were found during a raid of her Labrador home in July 2020.

The 51-year-old has been protesting her ignorance of the weapons since she was first charged.

Wolfram was once the president of the Surfers Paradise chapter of the notorious bikie gang the Mongols. He has spent the past two years bouncing between prison and rehabilitation facilities for drug addiction.

Defence lawyer Michael Gatenby told the court last week that Wolfram had given an interview to police, admitting his mum did not know about the weapons.

He said Wolfram told police: “Yes, they are mine. Mum had no idea I put them in the shed.

“She is really cranky with me.”

Mr Gatenby, of Gatenby Criminal Lawyers, said Gearing told police during the raid they would find a wad of cash that belonged to her younger son who was saving for a car.

Police seized that cash.

“The point being raised is that Victor Wolfram is accepting criminal responsibility,” Mr Gatenby said.

“This has been a live issue since (Gearing) was charged until two years ago.”

The court file shows it was first raised in October last year that Wolfram was taking full criminal responsibility.

Mr Gatenby said Gearing had been unable to work for the past two years as she had lost her Blue Card due to the charges.

The matter was to go to a hearing last week but prosecution asked for an adjournment because two witnesses were sick.

Police prosecutor Senior Constable Andrew Smith said Gearing’s matter should not be heard until Wolfram had entered a plea for the charges.

Magistrate Louisa Pink said it appeared to be the first time prosecution had asked for the charges against Gearing and Wolfram to be heard on the same day.

“It beggar’s belief why this has never been raised before by prosecution,” she said.

“Prosecution have not covered themselves in glory.”

The matter was adjourned to August 25.
