A court has heard accusations the partner of a Nomads enforcer had knowledge of an alleged kneecapping and drove the ‘getaway’ vehicle in a home invasion both earlier this year, before she allegedly directed a family member to get rid of evidence.

Carly Moon, 42, former girlfriend of sergeant-at-arms at the Sydney chapter of the Nomads, Jason Wayne Bailey, 47, made an unsuccessful bid for bail in the Supreme Court on Wednesday.

Moon, Bailey and another senior Nomad Justin Bell, 27, have been charged for their alleged role in the shooting of a 24-year-old man - a gang nominee - on the side of a remote road at Freemans Waterhole on April 8.

A court has previously heard the alleged victim was shot as a form of discipline after breaking club rules and was lured to the meeting spot on the pretences it was for a gang meeting.

Police allege it was Bailey who fired the Luger pistol into the nominee’s leg, before he was then driven to Edgeworth where he was dumped on the side of the road.

Bailey and Moon also face charges in relation to a home invasion on March 8, where police allege Moon drove Bailey and another man to a woman’s home at Edgeworth, where they forced entry before assaulting her.

Moon is charged with aggravated break and enter, accessory after the fact of discharging a firearm to cause grievous bodily harm, conceal a serious indictable offence, participate in a criminal group to contribute criminal activity, act with intent to influence witness, threat/cause injury/harm to prevent information to police and numerous firearm offences.

Bailey and Bell are both charged with aggravated break and enter, participate in a criminal group, affray, assault occasioning actual bodily harm in company and use of an offensive weapon in company.

Neither of the trio have entered pleas to the charges.

In Moon’s bail hearing, the court heard in regards to the alleged kneecapping, the alleged shooter (Bailey) had used Moon’s vehicle on the night in question.

The Crown Prosecutor submitted that she did in-fact have knowledge her vehicle was used, before police allege she stored the pistol used in a shed.

He told the court a telephone intercept on August 11, before her arrest, “clearly indicated” she had some knowledge of the alleged kneecapping.

There were also questions arising about Moon driving the ‘getaway’ vehicle in the alleged home invasion.

The court heard the 42-year-old had allegedly directed a family member to collect ammunition and conceal firearms, in a bid to get rid of evidence.

Moon’s defence barrister told the court the Crown’s case could not be described as strong and risk could be mitigated with strict conditions if his client were released.

He said the 42-year-old had no criminal history, no underlying drug or other addiction issues and she had cut ties with the alleged principal offender.

The court heard Moon had strong community ties, was supported by family in court and on release would have gainful employment working from home to manage personal trainers.

But the Judge refused the bail application and said her willingness to do everything she could to assist her then partner to avoid detection, could see her potentially engage in those tactics again.
