Gai Kuai Gai sentenced for assaulting police officer, hamburger shop staff in Miranda

A man has been sentenced for assaulting a police officer and a hamburger shop owner after he became so enraged in two violent incidents in Sydney’s south.

A Sylvania man has avoided jail after he bit a female police officer in the leg and punched a hamburger store staff member in two separate incidents.

Gai Kuai Gai, 24, was sentenced in Sutherland Local Court on Tuesday to several assault charges.

Agreed facts tendered to court said Gai, who worked as an electrical apprentice, was attempting to re-enter Miranda Hotel on December 17 after being asked to leave because he was drunk.

Police were conducting licence premise inspections and spoke to Gai who was belligerent and attempted to walk away.

He pushed a female police officer in the shoulder but was restrained on the ground where he thrashed at officers and swung his legs.

Gai then bit the officer through her pants on her inner left thigh causing pain, swelling and bruising.

Officers placed him into a caged vehicle and was agitated before he struck his forehead against a door in the station and needed to be sedated.

Gai pleaded guilty to being an excluded person remaining in the vicinity of a licence premises, resisting police and two counts of assaulting police officers.

On October 22, Gai went to a hamburger shop called Cow Cult Burgers at Miranda Mall because he was angry he had not received his food that he ordered through Menu Log.

The store owner explained to Gai he had no control over the delivery of food, which Gai refused to accept.

The owner gave Gai his burger even though it was an hour old and Gai took one bite before he lost his temper and threw it at staff members, a court has heard.

Gai became enraged, screamed, and yelled at staff prompting the store owner to walk around the counter to de-escalate the situation but Gai refused to calm down and he put his forehead on the man’s head.

The owner pushed Gai back before another owner came to protect the owner.

Gai and the staff member began to throw punches and at one point Gai was struck and had gash near his eye.

A member of the public intervened and held back Gai, who continued to make advances towards the shop until police arrived.

Officers saw Gai was still agitated and made clenched fists before he said, “he’s dead,” pointing at the shop.

Gai was arrested and pleaded guilty to behaving in an offensive manner, two counts of intimidation and two counts of common assault.

Magistrate Hugh Donnelly commended Gai for no longer drinking alcohol and noted his character references, including from his boss, spoke highly of him as being a “gentle and generous person”, adding he had completed TAFE courses.

Mr Donnelly said Gai had good prospects of rehabilitation despite the offence being serious.

Gai was sentenced to a 12-month intensive correction order where he must complete drug, alcohol and mental health counselling and 150 hours of community service.

He was also fined $1000 and placed on a 18-month community corrections order where he must be of good behaviour.
