A Beverly Hills man shot in an alleged attempted murder has appeared in court for unrelated charges.
Asesela Davui, 34, appeared from custody in Sutherland Local Court on Monday where he admitted to having housebreaking tools after he was found in a taxi only hours after police paid him a visit to confirm he was abiding by his curfew in May.
The court also heard Davui was serving an intensive corrections order at the time after previously being convicted of aggravated break and enter offences.
Davui is also named on a firearm prohibition order and has an extensive history of drug and property offences, the court documents said.
Last week, The Daily Telegraph revealed that police will allege Moustafa Mariam tried to shoot dead Davui on March 14, 2021 after a wild night which began about 6pm with the alleged kidnapping and detention of Davui’s friend Issa Hammoud.
Police allege in the 10 hours that followed Mariam, an alleged member of the Mariam crime clan, and a co-accused tried to use the kidnapping of Mr Hammoud to lure Davui to their location, before opening fire nine times on his car when he arrived – wounding him in the leg and buttock.
Police also allege the attempted murder was spurred by a problematic drug deal that saw Mariam’s brother Adam left fighting for life after consuming heroin rather than what he thought was cocaine.
The court also heard that police allege before Davui arrived, Mariam unleashed a torrent of violence against Hammoud.
With Mr Hammoud allegedly being subjected to ongoing attacks, the court heard that “at some stage a phone call was made by (Mariam) using Mr Hammoud’s phone so as not to raise any suspicions in Mr Davui’s mind” about him attending the location the alleged attackers were trying to lure him to.
The details were aired in the Downing Centre Local Court last week when Mariam unsuccessfully applied for bail.
Meanwhile, the St George Shire Standard can reveal Davui was the same man targeted by St George Police’s “prevention disruptions response” on May 30 this year after learning he was allegedly breaching his bail conditions for unrelated charges.
In agreed facts tendered to court, Davui was at the time on strict bail conditions including abiding by a night-time curfew where he had to remain at home between 9pm and 7am unless in the company of family members.
Police checked on Davui’s whereabouts, confirming he was at home on May 30 at 12.30am.
However, officers later received information that Davui was getting into a silver taxi close to his home about 3am, documents said.
Police stopped a taxi along Melvin Street and Stoney Creek Road in Beverly Hills, finding Davui in the back seat.
Officers searched the car and located a black sports bag in the footwell of Davui’s seat, before the driver confirmed he had entered the car carrying it.
Police found house breaking implements including a lock pick device, small hammer, balaclava, three pairs of gloves, a foldable utility knife, and a wallet, drivers licence, Medicare care and credit card in the name of another man.
Davui was arrested and denied owning the items and the bag.
He told police he was going to hospital but the driver confirmed he had booked the taxi to take him to an address in Kogarah.
Davui was taken to the police station where he was charged.
In court, Davui’s lawyer entered pleas of guilty to possessing housebreaking implements, custody of a knife in a public place, face disguised with intent to commit an indictable offence and having goods in custody.
Davui was originally due to defend the allegations at a hearing on Monday.
The case was adjourned to Burwood Local Court on October 21 for sentence.
