An international student allegedly attacked his partner with such force that she may never see out of one eye again, a court has heard.
Edson Roddy Cano Mitac, 29, fronted Sutherland Local Court on Thursday after being arrested and charged with two counts of assault occasioning bodily harm, common assault, and knowingly contravening an apprehended violence order.
In court, police alleged Cano struck, bit, and dragged his partner through her Wolli Creek apartment in the early hours of July 13.
Court documents allege he entered the apartment between 10pm and 3am that night, breaking an AVO in the process.
The court heard the woman attempted to seek help by calling triple-0 but Cano allegedly took the phone from her, rendering her “effectively helpless”.
Police allege she then hid from Cano inside the apartment until officers arrived.
During his bail application, the police prosecutor said Cano’s actions were “vicious” and allegedly damaged one of the woman’s eyes so badly that after a number of medical appointments, she “still does not know if she will ever see out of it again”.
The prosecutor also there was “no confidence” in bail conditions being adhered to given his “complete disregard” for the AVO in effect at the time.
However, his defence lawyer submitted that her client thought the AVO was finished after being found not guilty of another domestic violence-related incident against the same woman on July 5.
She told the court Cano sought bail to continue his studies having travelled to Sydney last year as an international student from Lima, Peru.
The court heard Cano, who now lives in Hornsby, was attending classes at an International College in the CBD on a student visa while he worked as a food delivery driver on his electric bike.
But Magistrate Philip Stewart found Cano’s bail plea less than satisfactory.
He said the Peruvian national posed a risk to the safety of the community and knowingly breached his domestic violence order while a “no approach” rule was in place.
The remarks prompted Cano to shake his head as a Spanish translator relayed what had been said.
In refusing him bail, Mr Stewart said he was “not satisfied” with letting Cano walk free from custody as the alleged attack was “horrific in the circumstances (reported by police).”
Cano will return to court next month.
