Magot Machol, Abuk Nagle granted bail after alleged domestic violence on Wolli Creek train

A couple have been banned from seeing each other over an alleged assault on a train in Sydney’s south.

A couple have been banned from seeing each other after they were granted bail for allegedly assaulting each other on a train.

Magot Machol, 33, and Abuk Nagle, 28, applied for release at Sutherland Local Court following their arrest last week.

The court heard Machol and Nagle were on a train near Wolli Creek on Wednesday about 10.30am with other passengers on-board.

Police allege Nagle pushed Machol in the chest, and swung at him before she moved away.

Police allege Machol then got up from his seat, stood over Nagle and put his hands around her neck.

The court heard other passengers witnessed the alleged interaction, captured footage, and contacted police.

Machol was charged with common assault, contravening an apprehended violence order and intentionally damaging property.

Nagle was charged with common assault and contravening an AVO.

The court heard Machol worked as a labourer in the construction industry, lived alone and was an Australian citizen after migrating from Sudan from 2003.

Machol’s lawyer conceded the alleged offence was serious because it was a domestic violence incident and involved a contravention of an AVO with violence.

He said Machol was not the “instigator” of the alleged interaction.

Machol was granted bail to live at his Ashfield home, report to police three times a week, not contact or go near Nagle nor her home, and he must comply with conditions of the AVO.

Nagle must live at her Werrington home, comply with conditions of the AVO and continue to undertake domestic violence counselling.

Machol will reappear in court on January 10 and Nagle is due to return to court on January 17.
