Truck formed rolling roadblock to force drink-driver off the M1

A dimwitted sparky could face jail after he was so drunk behind the wheel on the M1 motorway that a frightened truckie had to use his semi-trailer as a rolling roadblock to get him to pull over.

A dimwitted sparky could face jail after he was so drunk behind the wheel on the M1 motorway that a frightened truckie had to use his semi-trailer as a rolling roadblock to get him to pull over.

It comes as an agreed set of police facts tendered in court reveal the 31-year-old Gorokan man told police he’d had eight schooners of VB and an unknown number of spirits earlier in the evening.

Daniel Noel John Francis McGarry pleaded guilty to high-range drink-driving at Gosford Local Court where his solicitor said it was his second offence within six years.

According to a set of agreed facts, police were called to the M1 at Mount White at 12.17am on May 7 following “multiple triple-0 calls” about the way McGarry was driving.

“The accused was driving with the hazard lights of his vehicle activated and drifting all over the road,” the facts read.

“As the accused neared the Mount White Heavy Vehicle Inspection Station one motorist utilised his semi-trailer to direct the accused into the Heavy Vehicle Inspection Station before other motorists assisted in blocking the accused so that he could be assisted.”

Police arrived at 12.49am and McGarry, an electrician, told them he could not produce his licence because he had misplaced it.

“Upon being spoken to the strong scent of alcohol could be smelt on the breath of the accused and his eyes appeared bloodshot and his speech was slurred,” the facts read.

He failed a roadside test and when he was eventually taken back to Gosford Police Station he recorded a blood alcohol reading of 0.208 — more than four times the legal limit — at 1.35am.

“The accused stated to police he had consumed at least eight schooners of Victoria Bitter beer, as well as an unknown number of glasses of spirits over a four-hour period at Wyong Rugby League Club in Gorokan,” the police facts read.

McGarry told police his first drink was at 5pm and he didn’t have any food.

Magistrate Ron Maiden ordered he undergo a pre-sentence report before the matter returns to court next month.
