A motel manager has pleaded guilty to a home invasion, intimidation and demanding property when he tried to evict a guest who was behind in his rent but went about it completely wrong, a court has heard.
Madyn Kassem, 29, of Granville, faced Wyong Local Court on Tuesday where he pleaded guilty to aggravated enter dwelling in company, intimidation and demanding property with menaces.
An agreed set of facts states Kassem, who was known by the name ‘Mick”, was the manager of The Entrance Motel - across the road from the Diggers club at Long Jetty.
The facts state a man and his de facto had been renting a room at the motel from April 12 last year.
By early July, the man was $1300 behind in his rent and told Kassem several times that he couldn’t pay because his mother had died, but the payments would be “forthcoming”.
At about 1.45am on July 22 last year, Kassem arrived in a Toyota Hilux at the hotel car park with four unknown males.
The facts state police will allege one of the unknown males was armed with an axe, however Kassem denies this and it will go to a disputed facts hearing.
Regardless, Kassem and the four unknown males banged on the door to the man’s room and pressed the doorbell.
“Taz, you lying piece of sh*t I know you’re here, open the door,” Kassem yelled to the man.
The facts state the man opened the door enough so he could speak to the offender through a gap and Kassem said “where is my money?” before he and the four men pushed inside and “stood over” the victim.
One of the unknown males said “you’re ripping Mick off, you’re taking advantage of him” and Kassem told the victim he had to leave.
“Get out you filthy pigs, you have 10 minutes to get out, you owe me money, pack your stuff right now,” Kassem told the man, his de facto and another woman who had been staying in the room without permission for about a week.
The man said he didn’t have any transport to leave.
One of the unknown males said to the other woman, who owned a Mitsubishi Mirage parked outside, “what about this car out here?”.
Kassem also asked the woman who owned the car before demanding “where are the keys, it’s our car now”.
“You are not f**king have them, you are not getting my car, I don’t give a f**k what yous do,” the woman replied.
The victim’s de facto called police and Kassem and the four males left, but before police arrived, Kassem returned to the room and told the victim: “I feel bad for what’s happened, you can stay another night”.
Kassem was arrested the following day and underwent a recorded interview in which he said the victim owed him $1300 in rent.
He said “the boys” stayed in the Hilux but “one of my mates followed me out of the car”.
“It was just to scare him because he when, when he came out, my mate seen him, Taz is massive, bro,” Kassem told the police.
On Tuesday, Kassem’s bail was continued and the matter was adjourned to Gosford District Court on January 16 to fix a disputed facts hearing and sentence date.
