A demolition worker did a proper job on himself after getting rotten drunk and carrying on belligerently before sexually touching a female police officer and landing himself in custody.
Troy Adam Bayliss, 42, of Parramatta, faced Gosford Local Court on Thursday where he pleaded guilty to behaving in an offensive manner, using offensive language in public, intimidating police and sexually touching a female officer.
An agreed set of facts states Bayliss was on a replacement bus service from Hornsby to Gosford train station in the early hours of December 5 when he started becoming “increasingly aggressive”.
One passenger was so concerned he rang Gosford Police to report Bayliss’ behaviour which included “racially vilifying” another passenger.
When the bus arrived at Gosford Station Bayliss boarded a northbound train and “began to drink alcohol and smoke cigarettes within the train”.
“The accused was asked to leave the train at this time, however refused to comply with the commands of ceasing smoking or drinking while on board,” the facts state.
At 1.36am two police officers arrived and got him off the train and asked him to sit down.
“During the interaction with police the accused was highly belligerent towards police and failed to follow any directions.”
Bayliss talked over them and at other times refused to speak.
“Police observed that the accused’s speech was slurred, he was unsteady on his feet, the accused became progressively more aggressive towards police as the interaction continued,” the facts state.
“The accused told police that he had consumed 10 beers and was trying to get to Sydney where he lived. Police noted an open bottle of what appeared to be wine in his backpack.”
More police arrived and Bayliss stood up and leant towards a female officer and “extended his right arm with an open palm and placed his hand on [the] Constable’s groin and left thigh”.
She said “don’t touch me like that bro” and other officers tackled him to the ground where he thrashed about and resisted arrest, the facts state.
He was taken to Gosford Police Station but police were unable to read him his rights because of his level of intoxication.
At 2.29am, while being booked into custody, he told one officer “I’m going to find where you live and do the same to you” and “when I get out of here you’re f...ed”.
He also threatened another “I’ll shoot you in the head”.
Magistrate Kirralee Perry sentenced Bayliss to two years jail with a non-parole period of 17 months.
With time served he will be eligible for release on May 4 next year.
