A 47-year-old woman slammed into the back of a parked car before blowing more than three and a half times the legal alcohol limit as well as testing positive for cocaine.
Joanne Mary Ryan, of Gwandalan, faced Wyong Local Court on Monday where she pleaded guilty to high range drink-driving with an illicit drug present in her system and possessing a small amount of a prohibited drug.
An agreed set of facts states Ryan was only a few minutes away from home on Wednesday, December 4, when she crashed her Lexus IS250 at 9.57pm on Gamban Rd.
“The accused has driven her vehicle and collided with the rear driver’s side of a parked Mitsubishi ASX,” the facts state.
“Residents heard the impact from the collision and went outside to see what had occurred.
“The accused was attempting to reverse her vehicle however was unable to due to her vehicle being stuck in the collision with the other vehicle.
“Witnesses were able to turn the vehicle off and confiscate her keys.”
The facts state witnesses asked the accused to get out of the car and sit on the kerb but she said she would sit in the back seat “and did so while witnesses ensured she did not flee the scene”.
Police arrived and she underwent a breath test, which returned a positive reading for alcohol. She did another test for drugs and it too came up positive for cocaine.
Ryan was taken to Wyong police station where she blew 0.182 — more than three and a half times the limit.
She also provided an oral fluid sample that again tested positive for cocaine.
“During a search of the accused’s property in custody a small resealable bag was located which contained cocaine. This was weighed to be 0.33g,” the facts state.
Ryan told police the cocaine was for personal use.
“In relation to the taking of drugs the accused stated she last consumed cocaine earlier that night,” the facts state.
Ryan represented herself in court where magistrate Robyn Richardson said it was “a very serious example of this type of offence”.
She ordered Ryan to undergo a full sentence assessment report to see if there were any other sentencing options available to the court other than full time incarceration.
Ryan’s bail was continued and she was adjourned for sentence on February 17.
