Update in case of man accused of taking Nick Kyrgios’ Tesla at gunpoint

A major update has emerged in the case of a man accused of taking Nick Kyrgios’ luxury Tesla from his mother at gunpoint.

The pressure is on the Director of Public Prosecutions in Canberra to progress the case of a man accused of stealing Nick Kyrgios’ Tesla at gunpoint.

Special magistrate Sean Richter asked prosecutor Caitlin Diggins what the “hold up” was in the case of a 32-year-old man who allegedly threatened Kyrgios’ mum Norlaila with a gun at her Canberra home on May 1.

Police allege he demanded the keys to the tennis champ’s green Tesla and took the vehicle but was later arrested by ACT Policing.

The man has pleaded not guilty to aggravated robbery, driving a vehicle without consent, failing to stop for police, resisting a public official and driving while suspended.

In the ACT Magistrates Court on Tuesday, defence lawyer Jan de Bruin asked for his client’s matter to be listed for a stay application due to the prosecution failing to produce outstanding items in the brief of evidence.

Ms Diggins said a police informant was in the process of producing 11 police body cam videos, with two already served.

The prosecutor said a stay wasn’t required, however Dr de Bruin said his client had been in custody for 14 weeks since his arrest and was unable to progress the matter until the brief was produced.

Mr Richter said there needed to be “pressure on the prosecution” to provide this material due to it being raised in the man’s last court mention.

“What’s the hold up,” Mr Richter asked the prosecution.

Ms Diggins said selected parts of audio needed to be redacted from the footage and would serve the rest “as soon as possible”.

Mr Richter said he will list the 32-year-old’s matter for a stay application and said the outstanding information was of “significant urgency” due to the defendant being in custody since May “without any proven charges”.

The 32-year-old did not appear in court when his matter was adjourned to later this month and was remanded in custody.

Police allege the man threatened Kyrgios’ mum Norlaila with a long barrel gun and demanded the keys to her son’s car.

The man allegedly asked her to demonstrate how to drive the vehicle before driving off.

Officers allege Kyrgios called police and used his smartphone app to track the car and imposed a speed limit on the vehicle which allowed police to safely follow it.

Police say they engaged in a “short pursuit” with the man, which was abandoned due to safety concerns for other road users.

The man was caught after police cordoned off a street at Ainslie and he was arrested at about 9.05am.
