A prisoner who attacked another inmate while in custody in Sydney’s west will face further jail time for his involvement, while his three co-accused inmates will fight their charges.

Jake Treyvaud, 22, Trevor Leal, 27, Andrew Beer, 22, and Kheenan Powell, 27, were each charged with assault occasioning bodily harm after an alleged prison fight against one prisoner at Parklea Correctional Centre on December 5, 2022.

Treyvaud is a former MMA fighter and champion junior wrestler who trained with UFC champion Alexander Volkanovski.

Treyvaud, Beer and Powell all pleaded not guilty to the sole charge when they faced Blacktown Local Court in July 16, while Leal pleaded guilty.

Court documents state Leal and Beer lived in the cell next door to the victim, and the fight had started when Leal, allegedly joined by Beer, cornered the victim in his cell while all the inmates were doing their laundry.

It was alleged Beer confronted the victim saying “I told you to stop banging on the wall” before allegedly punching him in the head multiple times.

The documents state Leal did the same, hitting the victim in the face and head as he covered his face in self defence and fell to the floor.

The victim managed to get to his feet, where it was alleged Beer used a sharp object to strike his face multiple times.

The documents state Beer then allegedly left the cell while Leal threw another punch at the victim, causing him to fall down again.

CCTV footage allegedly caught Powell running up to the second level of the prison where the victim’s cell was. It was alleged he kicked the victim in the chest and then left the cell.

The documents state the victim got to his feet again and, despite being in a dazed state, and managed to walk out of his cell and wander into the one next door.

It was alleged Treyvaud ran up the stairs and followed the victim into this cell, where he allegedly punched him in the face multiple times.

The documents state the victim used bed sheets to wipe the blood off his face and stumbled through the cell block to find an officer.

He was taken to hospital for his injuries, having suffered bruising and swelling to his face as well as cuts to his eye, ear and nose.

He also suffered a broken left thumb, which needed surgery and physiotherapy.

The whole altercation was alleged to have taken place over a 10 minute period.

Leal has been sentenced to 12 months jail over the incident. Treyvaud and Powell will face court in Blacktown for hearings on December 10 and November 1, respectively. Both hearings are estimated to take four hours.

Beer is expected to next face court in Penrith on October 31.
