A Goonellabah man is fighting to get out of jail after trying to stab a former cop with a large shard of glass in a horrifying attack during a meth-fuelled haze.

Tyreece Gomes, 21, lodged a prison sentence appeal on June 6 after being convicted and sent to jail for two years, with a non-parole period of 15 months.

He pleaded guilty to damaging property, intimidation, affray and failing to appear in accordance with bail while facing Lismore Local Court.

Witnesses heard a “loud disturbance” including “banging” and “smashing” along Shearman Dr, Goonellabah about 2am on February 8 last year, police state in court documents.

Gomes smashed the window of a caravan parked on the street before continuing down the road with co-offender Ezekial Copeland, 23, and allegedly Kooriarna Gomes, 20.

Another man stood and watched, but was not charged with any involvement.

One witness saw the older Gomes approach a house and repeatedly kick the front gate while waving a stick. He yelled out to his ex-partner, who he believed was inside.

“Where are you, I’m going to bash you”, Gomes said, according to the documents.

The witness again told Gomes the woman was not there and he said: “I know she’s in there why are you lying for (sic). I’ll run through that home and kill all you mothers--kers.”

The witness locked the door and called police, while the older Gomes ran back into the street, where a man stood inspecting the damage caused to his caravan.

The man, a 75-year-old former police officer, previously gave evidence in court and said he saw a group of four people running towards him while he was calling police.

A witness heard the commotion and came outside their house holding up a phone flashlight.

It’s alleged the younger Gomes noticed and threatened: “I’ll come smash your f--king phone you white c--t.”

Police state the group attacked the victim, not knowing he was a former officer.

The older Gomes threw a pane of glass at the victim, according to police, though the offender maintains it was a piece of wood, the documents state.

The younger Gomes was allegedly heard yelling: “Hit him, hit him with the c--t, f--king hit him.”

The ex-cop was punched and his phone was stolen when the younger Gomes noticed him filming the attack, police also allege.

The victim wedged himself behind his fence and the group moved away.

Copeland grabbed a large timber fence post while the older Gomes smashed another window on the caravan.

“This caused (Gomes) to injure himself, leaving blood and broken glass on the roadway”, police state.

Gomes said: “Pass me a shirt I’m bleeding out. Call me an ambulance.”

Copeland returned to the man and hit him in the leg with the timber, causing “bruising and swelling to the soft tissues to the victim’s thigh”.

Copeland wrestled the victim over the fence as he tried to “coax” the man out.

“Come out of your yard, you dog. You’ll probably get me done for trespassing. Come outside your yard to Shearman street my brother,” he said.

Copeland was told about a CCTV camera at the home and he replied: “F--k the police, I don’t give a f--k”.

“I’m going to kill you old dog. You hit my brother I’m coming back to kill you,” Copeland continued.

Police arrived and the group fled on foot. Officers were called to a nearby home shortly after in relation to Gomes’ injuries.

He told officers he hurt himself punching a window in his home and was taken to Lismore Base Hospital, but left before receiving treatment.

The next day, detectives matched fingerprints and blood at the scene, which led to the trio being arrested.

The younger Gomes told officers the older Gomes was “having a domestic with his misses”, according to police.

The caravan was left with $1500 worth of damage.

Copeland pleaded guilty to affray, being armed with the intention to commit an indictable offence, and two counts each of breaching bail and assault causing actual bodily harm.

Kooriarna Gomes was wanted by police on Wednesday after failing to appear in accordance with bail.
