Nimbin man Kes Novak, 46, sentenced at Lismore court for intimidation after threatening to kill his landlord

A North Coast man who believed he had worms “coming out of his ears” and threatened to kill his landlord while “frothing at the mouth” will remain in the community.

Novak was arrested and taken to hospital.

Kes Novak, 46 was sentenced in Lismore Local Court for intimidation and breaching an apprehended domestic violence order.

The landlord heard screaming coming from his house in Whian Whian, north of Lismore, about 9.30am on August 9.

The victim was aggressively confronted by Novak.

“The accused yelled at the victim about his self-diagnosis, being worms in his body and coming out of his ears, and threatened to kill the victim and himself,” police state in court documents.

“While yelling, the accused ripped off his T-shirt in rage.”

Novak wandered off, but returned and “aggressively yelled at the victim while frothing at the mouth”.

He began “threatening to kill the victim and everyone else”.

When police arrived, Novak denied threatening the landlord, but conceded he “got a bit angry”, the documents state.

Novak was taken into custody and then to hospital.

He pleaded guilty to all charges on December 12 and his case was finalised on June 20.

Magistrate Michael Dakin sentenced Novak to a two-year community corrections order.

Novak was ordered to take part in any mental health assessment and treatment directed by Community Corrections officers, including taking medication and undergoing counselling.

He was also directed to abstain from taking illicit drugs as part of the sentence.
