A Northern Rivers builder is on trial accused of waking up a woman by masturbating in her face and trying to rape her after a cocaine and alcohol-fuelled party.
But Goonellabah man Brett David Anderson told Lismore District Court allegations against him were “lies fabricated by a woman on meds’ and cocaine”.
The 34-year-old man is on trial before Judge Craig Smith in Lismore Courthouse pleading not guilty to one count of sexual intercourse without consent and two counts of sexually touching another person without consent.
A group including Anderson partied at an entertainment venue in 2022, the court heard.
The prosecution said the group drank alcohol on a hired bus to the venue and did lines of cocaine during the celebrations.
Jurors heard the bus stopped on the return trip and more cocaine was acquired, with one attendee shouting: “We’re back on.”
The court heard the alleged victim retired to watch a movie while the group partied into the night. Her bedroom door was partially open when she dozed off about 8pm.
Anderson denies entering her bedroom while she was “partially asleep”, touching himself and trying to force his penis into her mouth.
The alleged victim told police Anderson inserted his hand into her mouth, she put her hand on his hip and then scratched him to “stop him putting his d--k in my mouth”.
It’s alleged Anderson ejaculated into the woman’s mouth and she “spat it back on him”.
Anderson also denies telling the woman to “roll over so I can feel what it’s like to do you up the arse”.
Defence lawyer Jacob Tate suggested to jurors the woman’s husband had been in the room, not Anderson.
She exclaimed in court: “I saw red pants and I know it was Brett.”
The prosecution said the woman exchanged phone messages with Anderson and wrote: “Brett what you did was so f--king wrong, I told you ‘no’ not just once” and “I’m honestly broken … I can’t live with myself”.
The court heard she reported the alleged assault to her GP.
Mr Tate suggested the complainant did not make a report earlier because she “wasn’t sure” about the assault due to medications and alcohol in her system.
She replied: “No, I was scared.”
During cross-examination, the defence alleged the woman self medicated with prescription medication, cocaine and methamphetamines (ice) and had confided in Anderson and his partner.
She told the court she took prescribed medication and sent a text message to her mother telling her she was going to bed on the night.
