‘Completely arrogant’ Russell Island man forced by court to purchase licence after serial offending

“You just couldn’t wait to f**k me in the a**e”: A court has heard a serial unlicensed driver with entrenched anti-social behaviour stunned police during an aggressive and foul-mouthed intercept.

A serial unlicensed driver whose “completely arrogant behaviour and deadbeat attitude towards police” has seen him in front of the court on multiple occasions has been given a suspended jail sentence instead of a further disqualification period.

Appearing at Cleveland Magistrates Court on October 13 Brett Steven Mueller, 45, was sentenced to two months’ jail wholly suspended over 12 months after pleading guilty to one count of obstruct police and multiple counts of driving without a licence as a repeat offender and driving a motor vehicle without a licence while court disqualified.

The court heard Russell Island refrigeration engineer Mueller was observed at 10.13am and 10.48pm on February 5 last year by an off-duty police officer on High Street on the island when the defendant was known to have been disqualified from driving.

But it was on November 3 last year when Mueller was arrested after nearly hitting a police officer with his vehicle’s door while being aggressive and belligerent, the court heard.

Intercepted after observed driving while moving a jetski, a police officer had to put out his arm to protect himself as a furious Mueller exited his vehicle and stated:

“You just couldn’t wait to f**k me in the arse, could you?

“There are scumbags all over this place but you pick on me.”

The court further heard Mueller’s “entrenched anti-social behaviour”, poor probation attendance and “completely arrogant behaviour and deadbeat attitude towards police” meant he was unsuited to community-based orders.

Defence solicitor Kieran Smith said his client had worked full-time for the past three weeks as a refrigeration engineer, had completed a Queensland Traffic Offenders Program (QTOP) and acquired a driver’s licence.

“It has taken you quite some time but finally you have done it,” magistrate Deborah Vasta said.

“We had to grab you by the scruff and drag you to it but it is done.”
