Alleged murderer Benjamin Graham Urquhart to apply for bail, autopsy result delayed

A man accused of murder at a motel north of Brisbane last year will apply for bail as the wait for processing autopsy results stretches to more than a year.

A man accused of the alleged murder of another man at a motel north of Brisbane last year will apply for bail because of long delays in processing critical autopsy results.

Benjamin Graham Urquhart and a co-accused were charged with the murder of Christopher George Lymar, 48, at a Kallangur motel about midnight on February 12, 2022.

Mr Urquhart’s lawyer Mark Zeller told magistrate Ross Woodford there had been a significant wait on autopsy results.

Mr Zeller told Pine Rivers Magistrates Court this morning, March 6, that more than a year had elapsed since the post mortem was conducted — on February 14, 2022.

Despite that Mr Zeller said his client was still awaiting a certificate from the Coroner’s office confirming the cause of death.

“There was a specific part that was sent off for more specialist reporting in regards to the brain – and we still don’t have it,” Mr Zeller said.

He said his client would be applying for Supreme Court bail.

“The ongoing issue is my client wants to apply for bail,” he said.

“As your honour will understand, we get one shot.

“If we don’t have the certificate we can’t make a proper application.

“This has just been continually delayed and delayed.”

February 12 marked the one year anniversary of the death of Mr Lymar and also one year in custody for Urquhart.

Mr Lymar was found with injuries to his legs and head, with police stating at the time that several bladed weapons had been found at the scene.

Mr Lymar had worked as a gym instructor and an actor, according to his social media accounts.

The matter was adjourned to March 27 for mention.

Mr Woodford urged the prosecution to follow up on the autopsy certificate.
