An alleged hit-and-run murderer is still free in the community two years after the incident because of delays in receiving crucial evidence from car maker Audi.
Marsden resident, Umar Hussein Alkahalifa Al Enizi, 21, appeared in Beenleigh Magistrates Court today, January 25, charged with one count of murder, one count of failing to remain at the scene and exhibit respect for the deceased, and one count of unlicensed driving.
Troy Edward Vandenberg, 25, died — allegedly after being struck by a white Audi driven by Mr Al Enizi, then 20 — on September 17, 2021.
Before Mr Vandenberg was allegedly struck by the Audi, witnesses claimed to have seen him get out of his Toyota Camry, the court heard.
He was seen throwing what appeared to be a hammer or mallet at Mr Al Enizi’s car window, counsel for the Crown, Elise Sargent, told a Supreme Court judge hearing a bail application.
Witnesses said they saw Mr Al Enizi’s Audi mount a footpath and hit Mr Vandenberg.
It was alleged Mr Al Enizi’s Audi then deliberately swerved into Mr Vandenberg.
Mr Al Enizi’s lawyer, David Gilmore, said that they were still waiting for police prosecution to gather further evidence for the case to go ahead.
“They are waiting on a further addendum statement to come from Audi records,” Mr Gilmore said.
The police prosecution said that evidence, which had already suffered delays, could take more time.
“I’m told that getting the original statements from Germany could take a number of months and that the addendum statements could come in a similar time frame,” they said.
Magistrate Michael O’Driscoll said Mr Al Enizi would continue to remain on bail.
“Your client is on nail,” Mr O’Driscoll said.
“We’ll see what happens in the next mention.”
Mr Al Enizi is due to appear next in Beenleigh Magistrates Court on April 5 for committal mention.
