Qld forensic inquiry reveals failures in testing led to reduced conviction in some cases

A report is still outstanding in the case of a Central Queensland woman accused of murdering her two-year-old stepson, a court has heard.

Alicia Jane Lee, 23, was charged in February with one count of murder over the death of two-year-old Rockhampton boy Logan Shaun Hawkins.

Emergency services were called to a Frenchville address on January 18 and Logan was taken to Rockhampton Hospital and then rushed to Queensland Children’s Hospital in Brisbane, where he died the following day from a traumatic brain injury.

In a bail application made in the Brisbane Supreme Court on August 12, Crown prosecutor Aleksandra Nikolic said significant force was required to have resulted in the injuries that were identified by the doctor.

Ms Nikolic said it was alleged Ms Lee was the only adult with Logan at the time the fatal injuries were inflicted.

“The explanations provided by the applicant given that she was the only adult at home with the child do not align with the opinions of (the) doctor,” she said.

Ms Lee’s matter was mentioned before Magistrate Cameron Press in Rockhampton Magistrates Court on December 14.

She was not required to attend.

Police Prosecutor Stacey Bain said a report was still coming and asked for a “lengthy” adjournment until February 2023.

At the last mention on September 7, Ms Bain said a pathologist report was required and that it wouldn’t be ready until late January.

The court heard on June 1 that the report could take up to 12 months to complete from the date of the postmortem.

Solicitor Lachlan Robertson asked for the case to be adjourned to early March, noting there had been some delays.

Mr Press adjourned Ms Lee’s matter to March 1.

The court heard she was on Supreme Court bail and would not be required to attend court on the next occasion.

The bail was approved in August to live with a friend in Brisbane, meaning she would not be able to encounter Crown witnesses in the Rockhampton region.

Her bail conditions also stipulate she is not allowed contact with children under the age of 10 without supervision.
