Scott Jasperse jailed in Rockhampton Supreme Court for suspended sentence breach

A man has learnt the hard way what happens when he doesn’t stay away from drugs, having a suspended sentence activated. Here’s what happened in court.

A man has found himself back in court for breaching his suspended sentence, two months after he breached it the first time.

Scott Jasperse faced the Rockhampton Supreme Court for breaching a suspended sentence he received in 2018 for possessing dangerous drugs and the aggravated supply of drugs to an “unsuspecting barmaid”.

The court heard Jasperse only faced the Supreme Court in September last year for breaching the sentence following drug offences in Mackay in June that same year.

His sentence was extended by an extra 12 months on that occasion, with Jasperse also telling the court at the time he’d had a job offer he could take.

But just two months later, Jasperse was in trouble with the law again.

In November last year Jasperse was found with 0.2g of marijuana, tainted property and items suspected of being used in a drug offence.

In December he was dealt with in court, with the convictions breaching his Supreme Court suspended sentence.

“I take the view that it is not unjust to activate the whole of the sentence, because it was explained to you by both Justice Burns and myself,” Justice Graeme Crow told Jasperse.

“Persons are given suspended sentences because courts take the optimistic view that there’s a chance they can get away from the drugs and get back to society and work, but you’ve proven twice now you couldn’t.”

The court heard Jasperse had been held in custody for 106 days but could only take into account 71.

While Jasperse’s lawyer asked his client be immediately released, Justice Crow said he wouldn’t be doing that.

Justice Crow found the breach was proven and activated Jasperse’s full 18 month sentence.

He will be released on parole on March 6.
