A drunk man was witnessed by police trying to entice truck drivers to fight after a big night drinking at a 21st party.

Morgan-Josiah Paterson, 18, pleaded guilty on January 5 in Rockhampton Magistrates Court to one count each of public nuisance, obstruct police, contravene police direction and fail to appear in court.

Police prosecutor Brandy Butler said police observed Paterson yelling at two truck drivers sitting with their trucks, enticing them to fight, about 11pm on May 28, 2021.

She said police approached Paterson and told him to leave or he would be arrested for public nuisance.

“He told police they can’t tell him what to do,” she said.

Ms Butler said police gave Paterson another warning but his behaviour continued and he was then arrested.

She said police used handcuffs to restrain the defendant who immediately resisted and pushed away from police.

Ms Butler said while restrained, Paterson continued to struggle with police and when he was pushed up against the police vehicle, he continually pushed his body away from the vehicle and yelled at police to “get off” him.

She said he was slurring his words while yelling at police and strongly smelt of alcohol.

Ms Butler said that while in police custody, Paterson was given a police direction to provide his name.

She said he repeatedly responded with derogatory language.

Defence lawyer Ken Spinaze said his client was “fully cut” after drinking at a 21st birthday and was walking home with his cousin when they came across the truck drivers.

He said his client thought the truck drivers had taking photographs of him and his cousin as he thought he saw a flash go off.

Mr Spinaze said Paterson approached the truck drivers demanding to see the photographs and then delete them.

“He doesn’t recall being abusive towards police or resisting,” he said.

“He just recalls wanting to stand up.”

Paterson was fined $750, ordered to complete 60 hours community service with no convictions recorded.
