A Mackay father of two is fighting a verdict that resulted in four months behind bars and $110,000 forfeited to the Crown.

Scott Jasperse was jailed earlier this month for 12 months with parole release after one third after Magistrate Bronwyn Hartigan found him guilty of possessing tainted property – namely $109,965 in cash.

He is now arguing the verdict was “unsafe and unsatisfactory”.

Police found the huge cash stash along with drugs – marijuana and ecstasy – and utensils while searching a Grasstree Beach property on August 27, 2020.

The cash was alleged to be tainted property, to which Jasperse pleaded not guilty.

Four days later, Jasperse was caught with more drugs, a water pipe and a phone.

He refused to give police access to the phone, citing a number of excuses including it was not his, it belonged to a prostitute and he wanted to protect the identity of his children.

Ms Hartigan had found the “weight of the evidence points to you concealing some form of unlawful conduct”.

Ms Hartigan found, looking at all the circumstances of the case, the cash met the definition of tainted property, meaning it “derived from the commission of an offence”.

She had said she found this “to be most likely a drug offence by reference to the items seized by police on that day”.

Ms Hartigan said Jasperse showed no remorse by “running a hopeless case in my view” – she also said his refusal to allow police access to his phone struck “at the heart of the criminal justice system”.

The 40 year old had been on a suspended jail term at the time he committed the offences. The cash and all the drug utensils were forfeited to the Crown.

Jasperse has filed an appeal in the district court against the penalty on the grounds “the verdict was unsafe and unsatisfactory”.

The case will be listed for a later date.
