Gympie woman Chloe Elizabeth Spillane blew .328 after crashing her car on Anzac Day

A 37-year-old Gympie hospitality worker was close to having alcohol poisoning when she got behind the wheel of her car, crashed it at a busy intersection then got abusive with police.

A young Gympie woman wiped away tears as magistrate Chris Callaghan told her she was an alcoholic and needed “to do something about it” in court last week.

Hospitality worker Chloe Elizabeth Spillane, 37, pleaded guilty to driving under the influence of liquor and obstructing police in the Gympie Magistrates Court on Thursday (August 5), stemming from an incident on Anzac Day, 2021.

The court heard police were called to the scene of a car crash at the corner of Louisa St and Channon St at about 7pm on April 25, and found a white Toyota with damage to the front and bonnet.

Spillane was found at the scene trying to jump-start the vehicle, appeared unsteady on her feet and had slurred speech when she told an officer she was the owner and driver of the vehicle.

Prosecutor Michael Phillips said Spillane “became abusive and flailed her arms around” when she was told to get her belongings from the vehicle.

Sgt Phillips said Spillane had difficulty with her seatbelt once she was directed to the police car, and later tried to open the door and exit the vehicle before she had to be stopped and placed back inside.

Spillane continued to be “abusive and argumentative”, and was “unable to follow simple instructions” given to her by the officers.

Sgt Phillips noted Spillane had previous drink driving convictions and it was clear she had issues with alcohol “over a long period of time”

He told the court Spillane returned a breath test reading of .328, more than six times the legal limit and “close to a level where people die of alcohol poisoning”.

“The way I acted was absolutely disgusting,” Spillane told the court, saying she “made that stupid decision to drive” and would be “going to speak to people about it”.

Mr Callaghan told Spillane she was an “experienced drinker” and had put herself and others “at great risk of very serious injury if not death” by getting behind the wheel.

“You are an alcoholic and you’ve got to do something about it,” Mr Callaghan told her.

Spillane was placed on 18 months’ probation, given 60 hours community service, and banned from driving for 20 months.
