Amber Moore in Gladstone court for not giving police access to her phone

A Central Queensland mum on a string of charges has faced court after she refused to give police access to her mobile phone during a drug raid.

A Central Queensland mum who refused to give police access to her electronic devices during a drug raid has found herself before the court for a litany of crimes.

Amber Sarah Moore, 29, pleaded guilty in Gladstone Magistrates Court on September 27 to numerous charges including possessing dangerous drugs, possession of suspected stolen property.

The two most serious offences related to not giving police access to information stored electronically.

The court heard that on October 26 last year, police found Moore in possession of methamphetamine while they executed a search warrant at Gladstone.

On the same day, she contravened an order in relation to accessing information on her mobile phone, and she also contravened a similar order in May this year.

The court heard the suspected stolen property included clothing.

It was told that Moore had a “limited” criminal history, containing two offences of assault occasioning bodily harm and “dated” drug offending.

Police prosecutor Sergeant Kevin Ongheen said the two most serious charges were the contravening order charges.

“The authorities describe the disobedience of those court orders as striking at the heart of justice,” Sgt Ongheen said.

“The actions by (Moore), in not providing the (mobile phone) pin code (twice), speak to (her) taking guarded actions to protect something.

“And in regards to the second offence (in May), it actually related to three phones.”

Sgt Ongheen said Moore had been prepared to disobey the court orders rather than divulge the contents of her phones.

“The (contravene order) offence... has a maximum penalty of five years (imprisonment) which is indicative of how seriously the legislators take this offence,” the prosecutor said.

Solicitor Bianca Wieland said Moore was a stay-at-home mother of three who held a child care certification as well as qualifications in horticulture and retail.

Magistrate Mary Buchanan noted that Moore was given multiple opportunities to provide police with her pin codes but she told officer: “I don’t want to be known as a dog”.

Ms Buchanan told Moore the offending “is serious” and she sentenced her to nine months’ jail, wholly suspended for 18 months.

Convictions were recorded.
